Exorbitant Billing and the Hope for Abia Residents: ASERA’s Oversight and the 200% Tariff Increase by Aba Power Electric Limited

In recent months, residents and businesses across Abia State have been grappling with a surge in electricity bills—many of them estimated and lacking any basis in actual meter readings. At the center of public outcry is a staggering 200% tariff increase introduced by Aba Power Electric Limited (APL), a move widely condemned as arbitrary, unjustified, and misaligned with the quality of service delivered.

However, with the recent handover of regulatory oversight from the Nigerian Electricity Regulatory Commission (NERC) to the newly constituted Abia State Electricity Regulatory Agency (ASERA), hope is beginning to flicker for a more responsive and accountable electricity governance structure in the state.


The Crisis of Estimated Billing in Abia

Estimated billing remains a pervasive challenge in Nigeria’s power sector. In Abia—particularly within the Aba Ring-Fenced Area—thousands of consumers continue to pay exorbitant amounts for electricity they neither consumed nor received reliably.

In the absence of prepaid meters, customers are subjected to arbitrary estimations, calculated using opaque formulas that rarely reflect actual usage. Monthly bills that once ranged between ₦8,000 and ₦12,000 have reportedly skyrocketed to ₦45,000–₦50,000, despite the erratic nature of supply.

The recent 200% tariff hike by APL has only compounded the situation, prompting widespread protests, petitions, and appeals to both NERC and APL. Unfortunately, many of these complaints have gone unanswered, further deepening public distrust and frustration with the distribution process.

ASERA: A Beacon of Localized Regulation

In a landmark shift, NERC recently approved the devolution of electricity regulatory responsibilities to subnational agencies under the Electricity Act 2023. Abia State responded by establishing the Abia State Electricity Regulatory Agency (ASERA), tasked with overseeing the generation, transmission, and distribution of electricity within the state.

ASERA’s responsibilities include:

  • Setting and regulating tariffs in Abia State
  • Enforcing service delivery standards
  • Investigating and resolving consumer complaints
  • Promoting transparency in metering and billing
  • Licensing local electricity providers

This decentralization marks a significant opportunity to tailor regulation to the unique needs and realities of Abia residents. Being physically located within the state, ASERA is expected to be more accessible and attuned to local challenges than the previously distant, Abuja-based NERC.


Can ASERA Tackle Excessive Billing?

The success of ASERA will ultimately depend on its ability—and willingness—to act swiftly and independently against consumer exploitation.

Electricity users across the state are hopeful that ASERA will:

  • Investigate the legality, fairness, and economic impact of the recent 200% tariff hike
  • Enforce the mandatory metering of all customers, ending the era of estimated billing
  • Establish transparent and functional complaint-resolution mechanisms
  • Ensure that all tariff changes undergo public consultation and adhere to due process

Civil society organizations such as the Foundation for Environmental Rights, Advocacy and Development (FENRAD) are already calling on ASERA to audit APL’s billing practices and place a moratorium on any further tariff increases until a thorough review is conducted.


Consumer Rights and Responsibilities

As regulatory power shifts to ASERA, consumers must become more proactive in asserting their rights:

  • Demand a prepaid meter: Under the National Mass Metering Programme (NMMP), customers are entitled to free meters.
  • Challenge inflated bills: Any estimated bill must align with NERC-approved methodology. Disputes can and should be escalated to ASERA.
  • Keep documentation: Always retain evidence of interactions with APL or ASERA for use in formal complaints.
  • Participate in stakeholder forums: ASERA is expected to host periodic engagements. Active civic participation will be key to reform.

A Turning Point for Electricity Consumers in Abia?

The creation of ASERA is more than a bureaucratic adjustment—it holds the promise of transformational change. If allowed to function independently, free from political interference and utility influence, ASERA could emerge as the credible watchdog that consumers in Abia have long yearned for.

But the agency’s credibility will be judged not by its existence, but by its actions. Residents are watching keenly to see if ASERA will confront the excesses of APL, enforce fair billing, and demand improved service delivery.

As Abians await the agency’s first decisive steps, the call remains urgent and unambiguous: Electricity must be affordable, accessible, and accountable. Anything less would betray the spirit of reform and the hopes of long-suffering electricity consumers.

Residents are encouraged to report exploitative billing practices, submit formal complaints to ASERA, and support advocacy efforts demanding fairness and transparency in electricity regulation.
